Terms of Service

SpeechCue is published by Apps by SAHARA.

These Terms of Service ("Terms") govern your use of SpeechCue ("the App," "we," "our," or "us"), a macOS teleprompter application. By downloading, installing, or using SpeechCue, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using SpeechCue, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. License Grant

2.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use SpeechCue on any Apple-branded device that you own or control, as permitted by the Mac App Store Terms of Service.

2.2 Restrictions

You agree not to:

  • Copy, modify, or distribute the App or any part thereof
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices or labels
  • Use the App for any unlawful purpose
  • Sublicense, rent, lease, or lend the App to third parties

3. User Content

3.1 Your Content

You retain all rights to the content you create using SpeechCue, including presentation notes, scripts, and speech text ("User Content"). We do not claim any ownership rights over your User Content.

3.2 Responsibility

You are solely responsible for your User Content and ensuring that it does not violate any third-party rights or applicable laws. Since all content is stored locally on your device, you are responsible for backing up and protecting your content.

4. Intellectual Property

SpeechCue and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. The App's name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks.

5. App Store Terms

Your use of SpeechCue is also subject to the terms and conditions of the Apple Mac App Store from which you obtained the App. In the event of any conflict between these Terms and the App Store terms, the App Store terms shall prevail with respect to your use of the App.

6. Updates and Changes

We may update, modify, or discontinue the App or any features at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the App.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. You assume all responsibility and risk for your use of the App.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of your device
  • Any interruption or cessation of the App
  • Any bugs, viruses, or other harmful code that may be transmitted through the App
  • Any errors or omissions in the App

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the App or violation of these Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiations. If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with applicable arbitration rules.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede any prior agreements.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Effective Date" at the top of these Terms. Your continued use of the App after any changes constitutes acceptance of the new Terms.
